MINUTES OF THE PUBLIC MEETING OF SEPEMBER 9, 2003

Called to Order:   This meeting was cancelled due to the fact that Chairman Arthur Gelsi resigned and Vice Chairman Ron Grattan was unable to attend.  Therefore, there was no quorum.

Public Hearings

7:30 PM  Request for Determination (RDA) for the repair of a failed septic system at a 603 Main Street, Assessors Map 33, Lots 17E with owners Joseph & Carol Connolly and Tyler Nims, P.E., 356 School St., Pembroke, MA.

Mr. & Mrs. Connolly were notified that the hearing was cancelled and they are rescheduled for September 23 at the same time.  Tyler Nims was also notified.

7:45 PM  Appointment with John Aiello

8:00 PM  Appointment with Don Weber, 56 Indian Path to discuss his Building Permit Application and filing an NOI.

*Mr. Weber came in to ask the Commission why he was required to file a Notice of Intent.  He was informed by the Agent and Board Members that were present that they were acting under the Wetland Protection By-Law and that he was required by law to submit the application for a variance.  He was given the paperwork for an Abbreviated NOI with instructions and told of the procedure for filing to relay to his Contractor.

8:15 PM  Appointment with SilverLeaf Landscape & Design to discuss their plans for business.

8:30 PM  Appointment with Douglas Pagnani of 92 Glenwood Place to discuss driveway issues.
 
*Mr. Pagnani came in to explain a driveway issue he has with his neighbor.  Ms. Gardner and Ms. Cassady will inspect his property on Sunday, September 14th at 7:00 AM to see what falls under our jurisdiction.

Orders of Conditions/Determinations of Applicability

Orders of Conditions for construction of a Retirement Community, Stonebridge Commons,    DEP #175-397, located at Liberty & Winter Streets, Assessor’s Map 90, Lots 5 & 5A and Map 91, Lots 14 & 16, applicant, Mark Ridder with special conditions:  see attached

ANRAD (Ammended Notice of Resource of Area Delineation) for Mark Ridder, for Liberty St., Assessor’s Map 91, Lot 14 & Winter St., Map 90, Lot 5 DEP #175-346

Orders of Conditions for installation of a new septic system at 112 Whitman St., Assessor’s Map 106, Lot 0006B, DEP #175-407, owners Ray Facillo & Nicole Coyman with special conditions.

Orders of Conditions for the installation of a septic upgrade within the buffer zone at 974 E. Washington St., Assessor’s Map 113, Lot 14-7 with owner Marylou Hobson and Shayne McGlone of McGlone Enterprises, Inc.  DEP #175-408 with special conditions.

Nothing was signed due to the fact that there wasn’t a quorum present.   All postponed.

Enforcement Order to Cease and Desist to Bob Nickerson, tenant, Michael Allegrini, owner for activity that has taken place at 1139 Main St., Map 43, Lot 36A, Hanson, Plymouth Liquors in violation of Public Hearing decision on August 12, 2003 to remove the unclean fill.  (see letter)

Ms. Cassady would like to set up a site visit with a Commissioner to inspect 903 W. Washington St., owner, Dan Maurano – Ms. Gardner will inspect with Ms. Cassady on Sunday at 7:00 AM

Ms. Cassady would like to set up an inspection of 143/148 Lakeside Rd..  A Mr. Murray has been pumping water into the streets & yards as well as tree-cutting. – Ms. Gardner will inspect with Ms. Cassady on Sunday at 7:00 AM.

Public Hearing Notice from Planning Board regarding Edgewood Estates, a 7-lot residential subdivision off Brook Street on Monday, September 15, 2003 at 9:00 PM.  
        
Public Hearing Notice from Board of Appeals regarding Silverleaf Landscape & Design, Inc., for site plan approval and a special permit on September 23, 2003 at 7:00 PM.
